Terms of Service
1. Who we are
This website (the "Site") is operated by Galaxioid OÜ, a private limited company registered in the Republic of Estonia (the "Company", "we", "us", or "our"). The Company provides advertising production services and develops and publishes games (together, the "Services"). You can reach us at contact@galaxioid.net.
2. Acceptance of these Terms
By accessing or using the Site, contacting us, or using any of our Services, you agree to be bound by these Terms of Service (the "Terms") and our Privacy Policy. If you do not agree with these Terms, please do not use the Site or the Services. If you are using the Site on behalf of a company or another legal entity, you represent that you are authorised to bind that entity to these Terms.
3. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to enter into agreements with us for the Services. Individual games we publish may have their own age ratings and additional terms presented within the relevant product or store listing.
4. Use of the Site
You agree to use the Site only for lawful purposes. You must not:
- attempt to gain unauthorised access to the Site, its servers, or any connected systems;
- interfere with or disrupt the operation of the Site, including by introducing malware or performing denial-of-service attacks;
- scrape, copy, or republish substantial parts of the Site's content without our prior written consent;
- use the Site in any way that infringes the rights of the Company or any third party.
5. Intellectual property
All content on the Site — including text, graphics, logos, names, designs, animations, code, game assets, and trademarks — is owned by or licensed to Galaxioid OÜ and is protected by applicable intellectual-property laws. Nothing in these Terms grants you any right or licence to use our intellectual property except as strictly necessary to browse the Site. "Galaxioid" and associated marks may not be used without our prior written permission.
6. Services and proposals
Information on the Site about our advertising and game-development capabilities is provided for general information only and does not constitute a binding offer. Specific engagements are governed by separate written agreements (such as a statement of work, master services agreement, or licence) concluded between you and the Company. In the event of any conflict between these Terms and such an agreement, the separate agreement prevails for the relevant engagement.
7. Games and third-party platforms
Our games may be distributed through third-party platforms and app stores (for example, web portals or mobile app marketplaces). Your use of those platforms is also subject to the platform operators' own terms and policies, which we do not control. Individual games may include their own end-user licence agreements or in-game rules, which apply in addition to these Terms.
8. Third-party links
The Site may contain links to third-party websites or services. We provide these links for convenience only and are not responsible for the content, policies, or practices of any third party.
9. Disclaimer of warranties
The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by applicable law, Galaxioid OÜ and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Site. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct or gross negligence under Estonian law.
11. Indemnity
You agree to indemnify and hold harmless Galaxioid OÜ from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.
12. Privacy
Our processing of personal data is described in our Privacy Policy, which forms part of these Terms.
13. Changes to these Terms
We may update these Terms from time to time. The current version will always be published on this page with the "Last updated" date above. Material changes take effect when posted. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with these Terms or the Site shall be submitted to the competent courts of Estonia, with Harju County Court (Harju Maakohus) as the court of first instance, unless mandatory consumer-protection rules in your country of residence provide otherwise.
15. Miscellaneous
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right under these Terms is not a waiver of that right. These Terms, together with the Privacy Policy and any separate written agreements referred to in Section 6, constitute the entire agreement between you and the Company regarding the Site.
